Terms and Conditions for PrivacyMatters2u Initiative:

Statement of Purpose

The PrivacyMatters2u Initiative (the “Initiative”) is a for-profit membership program operated by SummerSnow Publications LLC, a Minnesota limited liability company.

Membership in the Initiative provides educational tools, privacy training resources, and access to multimedia Shield Up! privacy quests and related member benefits.

Participation in the Initiative is governed by these Terms and Conditions (“Terms”). By enrolling as a member, you agree to be bound by these Terms.

Relationship to SummerSnow Publications LLC

The Initiative is a project of SummerSnow Publications LLC (“SummerSnow”).
Members of the Initiative have no ownership interest or financial claim to any part of SummerSnow Publications LLC or its other business divisions.

Membership Terms

Membership fees: Members may enroll in the Initiative through either (a) a recurring monthly subscription at the rate posted on the membership page (non-refundable except as required by law), or (b) a recurring annual subscription paying for ten months and receiving two months free (for a total of twelve (12) months) when paid in full (non-refundable except as required by law). All rates are subject to change from time to time.

Membership term:

For monthly subscribers, membership is provided on a month-to-month basis beginning on the date of enrollment.
For annual subscribers, membership is provided for a twelve (12) month period beginning on the date of enrollment.

Renewal:

Monthly memberships renew automatically each month at the prevailing membership rate unless cancelled prior to the renewal date.
Annual memberships renew automatically each year at the prevailing annual rate unless cancelled prior to the renewal date.
Membership benefits: Members receive access to Shield Up! privacy quests, guided cohort opportunities, member-only updates, and other benefits described on the Initiative website as updated from time to time.

Payments and Platform

The Initiative uses a third-party shopping platform and payment processor, Payhip with Stripe. You can find out more about Payhip at https://payhip.com/ and Stripe at https://stripe.com/. By accessing or purchasing Content from SummerSnow, you are agreeing to Payhip’s Terms of Use and Stripe’s Terms of Use.

SummerSnow uses EmailOctopus for its email campaigns. You can find out more about EmailOctopus at its website, https://emailoctopus.com/. By signing up for the Initiative, you are agreeing to SummerSnow’s use of EmailOctopus and to EmailOctopus’s Terms of Use. For more information, please visit EmailOctopus’s website.

Member Conduct

Members agree to:

Use resources for lawful personal use only;
Treat other members respectfully in online and offline interactions;
Communicate constructively and with kindness in Signal texting threads understanding that the groups are self-moderated and dependent on the self-regulation of the members
Protect other members’ privacy and refrain from unauthorized data sharing;
Comply with these Terms and all applicable laws;
Respect the copyrighted material owned by SummerSnow and its licensors and provided to Members for personal use only.

Violations may result in suspension or termination of membership.

Privacy Quests and Badges

Members may complete as many Privacy Quests during their membership year as are listed on the Member site.
Upon completion of each quest, members receive a Badge acknowledging their participation.
Quests are self-directed educational activities intended to raise awareness and promote better digital privacy practices.

Privacy Pup’s Surprise Thank-You Gifts

From time to time, and at its sole discretion, SummerSnow may offer non-monetary appreciation gifts (“Surprise Gifts”) to members who complete a certain number of quests or engage meaningfully with the Initiative.

Surprise Gifts are optional, discretionary tokens of appreciation and are not guaranteed.
Surprise Gifts do not represent wages, compensation, dividends, financial interests, or any form of profit-sharing.
The number and type of Surprise Gifts, as well as any eligibility criteria, may change at any time without notice.
Receiving or not receiving a Surprise Gift has no impact on membership status, rights, or access to Initiative materials.

This program is intended solely as an optional expression of gratitude and recognition and shall not be construed as a financial incentive or contractual promise.

Independent Program

The PrivacyMatters2u Initiative is not a cooperative, investment vehicle, or security offering.

Taxes

Members are responsible for reporting any gifts or other items received from SummerSnow as personal income where applicable under federal, state, or local law.

Affiliate Partnerships

Affiliate partnerships (e.g., with Incogni, NordVPN, Proton) are for educational and funding purposes.

The Initiative may receive commissions when members or the public purchase products or services through referral links. Affiliate relationships do not imply endorsement. SummerSnow is not responsible or liable for any interaction you may have with any affiliate or your relationship with any affiliate. By following a link from the Initiative website, you acknowledge and agree that you are leaving the Initiative website and are responsible for familiarizing yourself with the terms and conditions and privacy policy of any third party website, whether affiliate or non-affiliate.

Intellectual Property

All content, logos, training materials (including Shield Up), videos, graphics, and text associated with the Initiative are owned by SummerSnow. Members are granted a limited, personal, non-transferable, revocable license to view and use these materials for personal educational purposes only.

Disclaimer & Limitation of Liability

Membership in the Initiative does not guarantee any specific outcome, financial return, or data-privacy result. Membership participation and quest completion are voluntary.

SummerSnow and its affiliates are not responsible for any data loss, technical issues, or damages arising from privacy actions taken by members (e.g., account deletions, settings changes, or third-party software use or malfunction) arising from participation in the Initiative or use of its materials.

Use of the Initiative-provided materials is at your own risk.

Termination

Membership may be cancelled by either party with written notice. If you cancel your membership at any time, it will terminate at the end of your then-current subscription year.

SummerSnow reserves the right to discontinue the Initiative or modify its structure at any time, with reasonable notice to members.

Returns

All purchases from this website are non-refundable. If you purchase an Initiative-branded item from the third-party website Printify, refunds are governed by Printify's policies.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles.

By joining the PrivacyMatters2u Initiative, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

DISCLAIMER OF WARRANTY

YOUR ACCESS TO AND USE OF THE CONTENT IS AT YOUR SOLE RISK. ALL MATERIALS, INFORMATION, SERVICES AND CONTENT ARE PROVIDED “AS IS,” WITH NO WARRANTIES OR GUARANTEES WHATSOEVER. SUMMERSNOW EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, GUARANTEES, OR REPRESENTATIONS, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY AND INTELLECTUAL PROPERTY RIGHTS. WITHOUT LIMITATION, SUMMERSNOW MAKES NO WARRANTY OR GUARANTEE THAT THE CONTENT OROR THE SERVICES WILL BE UNINTERRUPTED, CORRECT, COMPLETE, TIMELY, SECURE, OR ERROR-FREE OR THAT DEFECTS IN THE SERVICES OR THE CONTENT WILL BE CORRECTED.

YOU UNDERSTAND AND AGREE THAT IF YOU OBTAIN MATERIALS, INFORMATION, CONTENT, OR SERVICES, YOU DO SO AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES THAT MAY RESULT, INCLUDING LOSS OF DATA OR DAMAGE TO YOUR COMPUTER SYSTEM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

LIMITATION OF LIABILITY

IN NO EVENT WILL SUMMERSNOW BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY TYPE WHATSOEVER RELATED TO OR ARISING FROM THE SERVICES OR THE CONTENT OR ANY USE OF THE SERVICES OR THE CONTENT, OR OF ANY SITE OR RESOURCE LINKED TO, REFERENCED, OR ACCESSED THROUGH THE SERVICES OR THE CONTENT, INCLUDING, WITHOUT LIMITATION, SQUARE, PAYHIP, EMAILOCTOPUS, AND SPONSORED LINKS, OR FOR THE USE OR DOWNLOADING OF, OR ACCESS TO, ANY MATERIALS, INFORMATION, PRODUCTS, OR SERVICES, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOST SAVINGS OR LOSS OF PROGRAMS OR OTHER DATA, EVEN IF SUMMERSNOW IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS EXCLUSION AND WAIVER OF LIABILITY APPLIES TO ALL CAUSES OF ACTION, WHETHER BASED ON CONTRACT, WARRANTY, TORT, OR ANY OTHER LEGAL THEORIES.

AGREEMENT UPDATES

SummerSnow reserves the right to make changes to this Agreement at any time SummerSnow will inform people of changes to the agreement by email 30 days in advance, and continuing to participate will constitute agreement to updated terms If any change to this Agreement is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes and the remainder of this Agreement. Your continued use of and access to the Content, the Initiative, and the SummerSnow services after changes to this Agreement constitutes your acceptance of the changes. If you do not agree to any changes, you must stop accessing or using the Content and the Initiative.

DISPUTES

You agree that this Agreement and your purchase of Content from SummerSnow are governed by the laws of the State of Minnesota, without regard to conflict of law principles. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in Minneapolis, Minnesota, in all disputes arising out of, relating to, or concerning SummerSnow products and/or this Agreement. If any part of this Agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall govern.
